Employment Practices Liability Insurance, or EPLI, protects businesses against employees who claim their legal rights as a part of the company have been violated in some way.

In a litigation-heavy society, the numbers of lawsuits against employers by their employees is, unsurprisingly, on the rise. The majority of the volume is, surprisingly, against small companies.  No one is immune.

EPLI coverage helps protect your business against a wide range of lawsuits from employees, including:

  • Claims of sexual harassment
  • Discrimination based on race, sex, religion, etc.
  • Failure to employ
  • Infliction of emotional distress
  • Breach of contract
  • Wrongful termination
  • Wrongful discipline

The cost of EPLI coverage fluctuates in accordance to the type of business being insured, the size of the company, and any potential risks to the insurance company such as if the company has been taken to court over employment practices before.  The premium cost may be as low at $250.

EPLI policies reimburse the costs associated with defending a company, as well as any judgments or settlements that require payment. The coverage pays for legal costs as well, regardless if a company wins or loses in court.

EPLI policies typically do not cover damages or fines, and liabilities covered by other policies are excluded from EPLI coverage.

EPLI policies can and should be expanded to cover claims of discrimination by 3rd parties as well.
